TRANSFER DEEDS

A GRANT DEED is a transfer of title that implies certain promises by the grantor about the title of property. This is the most commonly used kind of deed.

A QUITCLAIM DEED is the transfer of ownership interest a person signing it may have in a particular property but does not guarantee anything about the extent of that interest.

A INTERSPOUSAL TRANSFER DEED commonly is a transfer of real property to a spouse or former spouse in connection with a property settlement agreement or decree of dissolution of a marriage or legal separation.

HOW TITLE IS HELD

A JOINT TENANCY is how title of property is held by co-owners and if either one of the co-owners die, the property passes on to the surviving owner by means of right of survivorship without being subject to probate.

A TENANTS IN COMMON is how title of property is held by co-owners and each owner having the freedom to dispose of their interests of the property by sale, gift or will.

REAL PROPERTY LIEN

A LIS PENDEN is a notice of pendency of an action (a lien) in which a real property claim is alleged. By real property claim it means that there is cause of action (allegations in a lawsuit) being plead against the property which would, if meritorious, affect (a) title to, or the right of possession of specific property. This type of lien will prevent to transfer of the property until the lien is lifted.

PUBLIC DOCUMENTS PLUS PREPARES FORMS TO DO THE FOLLOWING:
• Transfer real property to one or more family members or friends;
• Place real property into Joint Tenancy giving the right of the property to another by right of survivorship;
